PlasmaDesk is computer-aided manufacturing (CAM) software that generates G-code and other machine control files for CNC plasma cutters, laser cutters, and similar equipment. The Software:
CNC plasma cutters, laser cutters, and similar equipment are inherently dangerous. They involve high temperatures, electrical hazards, fumes, radiation (laser), and moving parts that can cause serious injury, death, or property damage.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PLASMADESK, ITS OWNERS, DEVELOPERS, EMPLOYEES, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY:
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages. In any event, our total liability to you for all claims shall not exceed the amount you paid for the Software.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Software shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in New York, NY, or may be conducted remotely. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
YOU AND PLASMADESK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and PlasmaDesk agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

You agree to comply with all applicable export and import laws and regulations, including those of the United States. You represent that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, and that you are not on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Denied Persons List.
The Software and all associated content, including but not limited to code, design, graphics, and documentation, are the property of PlasmaDesk and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Software after any changes constitutes acceptance of the new Terms.
We reserve the right to terminate or suspend your access to the Software at any time, for any reason, without notice. Upon termination, your right to use the Software will immediately cease.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the other provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlasmaDesk regarding your use of the Software, and supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in New York County, New York.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
